Investigation agencies should stop playing with law, courts
Judge who rejected departmental probe merits promotion
The Pakistan Economy Watch (PEW) on Thursday demanded a re-probe into escape of Hamesh Khan, former President and CEO of Bank of Punjab from Peshawar Airport.
It said that investigating agencies should stop playing with courts, disregarding law and promoting officials involved in serious cases.
Dr. Murtaza Mughal, President of PEW demanded of the Chief Justice Pakistan Muhammad Iftikhar Chaudhry to constitute a special investigation committee to review the matter and ensure justice.
The name of Hamesh Khan was put on Exit Control List on 25th of April 2008 but he managed to fly out of the country from Peshawar Airport after that.
The then Advisor Interior suspended for officials on 20th July 2008. Five days later, an FIR No. 120/2008 was lodged against the accused.
The accused secured bail and later managed to get the inquiry of the case transferred to Islamabad where they were eventually exonerated.
Later, said Dr. Murtaza Mughal, the said federal department put the case in the court of Judicial Magistrate VII Tariq Abbas to get relief for the charged officials.
However, the magistrate raised serious observations on departmental findings and sent final report (challan) back for finalisation of probe on merit.
Dr. Murtaza Mughal said that the case was never submitted again in the court for trial in violation of the law as an investigation officer is bound to submit case in court within 15 days under section 173 Cr.P.C.
Insiders say that those interested in defending the accused were waiting for the transfer of judge to try anew for desired results. Tariq Abbas would never accommodate them as he is known as a person of unparalleled honesty, integrity and uprightness.
It is interesting to note that one of the accused and an inquiry officer has been promoted while the main accused, the supervisory officer, got favourable recommendations from superiors.
Concerned officers were repeatedly contacted but they weren’t willing to give their side of story. Dr. Murtaza Mughal has asked CJP to take notice of issue and order investigations so that those playing with the legal system should be taken to task.

اسلام آباد( دسمبر 09 ) پاکستان اکانومی واچ کے صدر ڈاکٹر مرتضیٰ مغل نے کہا ہے تحقیقاتی ادارے عدالتوں سے مذاق اورمقدمات میں ملوث افسران کو ترقیاں دینا بند کریں۔سپریم کورٹ کے چیف جسٹس افتخار محمد چودھری ہمیش خان کے ملک سے فرار کے تفتیش کے لئے خصوصی ٹیم تحقیقات پشاور بھیجیں۔زبردست دباﺅ کے باوجودمحکمانہ تحقیقات رد کرنے والے جج کو فوری ترقی اور انعام دیا جائے۔ ڈاکٹر مرتضیٰ مغل نے جمعرات کے روزیہاں جاری ہونے والے ایک بیان میں کہا ہے کہ بینک آف پنجاب کیس کے مرکزی ملزم ہمیش خان کو 25اپریل2008 ایگزٹ کنٹرول لسٹ پر ڈالا گیا مگراسکے باوجود وہ پشاور ائرپورٹ سے بیرون ملک فرار ہو گیا تھا جس پر اس وقت کے مشیر داخلہ نے وفاقی ادارے کے چار افسران کو 20جولائی 2008کو معطل کر دیا گیااورپانچ روز بعدانکے خلاف مقدمہ نمبر 120/2008درج کر لیا گیا۔ ملزموں نے ایڈشنل سیشن جج کی عدالت سے ضمانت کروا لی اور اثر رسوخ استعمال کرتے ہوئے کیس کی انکوائری اسلام آبادمنتقل کروا دی جہاںمحکمانہ انکوائری کے نتیجہ میں تمام ملزموں کو بے گناہ قرار دے کر بحال کر دیا گیا۔ وفاقی محکمہ نے مقدمہ خاتمہ کے لئے پشاورکے جوڈیشل مجسٹریٹ نمبر VIIطارق عباس کی عدالت سے رجوع کیامگر انھوں نے محکمانہ تحقیقات پر عدم اعتماد کرتے ہوئے کیس لوٹا دیااور صحیح رپورٹ پیش کرنے کی ہدایت کی۔ڈاکٹر مغل نے کہا کہ دفعہ 175ضابطہ فوجداری کے تحت مطابق مقدمہ کا چالان پندرہ روز کے اندر عدالت میں پیش ہونا تھا مگر مزکورہ ادارہ نے ابھی تک ایسا نہیں کیا۔بعض افسران کے مطابق وفاقی ادارہ جج کے تبادلہ کا منتظر ہو سکتا ہے تاکہ من پسند نتائج حاصل کرنے کی کوشش کی جا سکے۔ادھر مقدمہ میں ملوث تمام افراد نہ صرف خدمات سرانجام دے رہے ہیں بلکہ ایک ملزم اور انکوائری افسر کو ترقی بھی دے جا چکی ہے جبکہ “مثالی خدمات”کے پیش نظرمرکزی ملزم کی سفارش بھی کی گئی ہے۔متعلقہ افسران نے بار بار کے رابطہ کے باوجود اپنا موقف نہیں دیا۔ڈاکٹر مغل نے کہا کہ مزکورہ جج نے ہر قسم کا دباﺅ مسترد کر کے عدلیہ کی آزادی ، ایمانداری اور انصاف کی روشن مثال قائم کی ہے۔انھوں نے کہا کہ چیف جسٹس افتخار محمد چودھری قانون کی توہین کے اس واقعہ کا نوٹس لیںاورخصوصی ٹیم کے زریعے تحقیقات کروا کے انصاف کو یقینی بنائیں۔
